Seller Agreement

Last updated: 8 August 2026. This agreement applies to every seller account in addition to the Terms & Conditions.

1. Eligibility & registrations

  • You must be legally capable of conducting business in your jurisdiction.
  • India: obtain GST registration where required by the CGST Act, 2017; food businesses must hold a valid FSSAI license/registration; keep trade/Shop & Establishment licenses current; hotels must comply with state registration rules.
  • Other countries: hold the equivalent tax registrations, food-safety certifications, hospitality licenses and permits your law requires.
  • You must declare these identifiers in your Shop Settings; GSTIN/FSSAI are displayed on your public shop page.

2. Listings & pricing

  • Describe products truthfully with accurate images; misleading listings are prohibited under the Consumer Protection Act, 2019.
  • Display the total price including applicable taxes and declare correct tax rates and HSN/SAC codes.
  • Packaged goods sold in India must comply with the Legal Metrology (Packaged Commodities) Rules — MRP, net quantity, manufacturer details, country of origin.
  • Do not list prohibited or restricted items.

2A. Prohibited items

The following may not be listed on GoTender under any circumstances, whatever licences the Seller holds. Listings are removed on sight and repeat attempts end the Seller's account.

  • Medicines and drugs of any kind — including over-the-counter medicines, ayurvedic, homeopathic and unani medicines, and anything described as treating, curing or preventing a disease. Retail sale of drugs in India requires a state drug licence (Form 20/21) and a registered pharmacist under the Drugs and Cosmetics Act, 1940, prescription-only medicines (Schedules H, H1 and X) require a valid prescription against each sale, and there are no notified rules for the online sale of drugs. GoTender is not a pharmacy and does not operate as one.
  • Medical devices regulated under the Medical Devices Rules, 2017, unless GoTender has approved the Seller's device licence in writing.
  • Tobacco, e-cigarettes and vaping products; alcohol; narcotic or psychotropic substances.
  • Weapons, ammunition, explosives and their components.
  • Wildlife products, live animals, and anything restricted under the Wild Life (Protection) Act, 1972.
  • Counterfeit goods and anything infringing another party's trade mark, copyright or design.
  • Human organs, blood and tissue.
  • Cosmetics tested on animals, and cosmetics containing substances banned in India (including hexachlorophene, lead and arsenic compounds).

2B. Cosmetics & personal care

Cosmetics, personal care, grooming and beauty products are permitted. A Seller listing them must:

  • Hold and declare a cosmetic licence — a CDSCO manufacturing licence, an import registration (Form 43) for imported cosmetics, or the licence number printed on the pack of a licensed brand being resold.
  • Display on every listing the net quantity, batch or lot number, use-before/expiry date, and the name and complete address of the manufacturer (and importer, where imported), as required by the Cosmetics Rules, 2020 and the Legal Metrology (Packaged Commodities) Rules, 2011.
  • Make no medicinal or therapeutic claim. A cosmetic that claims to treat or cure a condition becomes a drug in law and falls under clause 2A.
  • Never list expired stock, and honour the stated expiry at delivery.

GoTender reviews cosmetic listings and licences, and may remove a listing or suspend a Seller where the required information is missing, unverifiable or false.

3. Orders & fulfilment

  • Keep stock and open/closed status accurate; confirm or cancel new orders promptly.
  • Deliver within your declared service radius in a safe, hygienic manner (food businesses must follow FSSAI hygiene standards).
  • Issue proper invoices/receipts where required by tax law — you are the seller of record.

4. Refunds, returns & complaints

  • Honour the Platform's Cancellation & Refund Policy and all statutory consumer rights.
  • Respond to customer complaints routed to you within 48 hours.

5. Taxes & legal responsibility

  • You are solely responsible for collecting, reporting and remitting all taxes on your sales.
  • You indemnify GoTender against claims arising from your products, services, listings or breach of law.

6. Data protection

Customer data shared with you (name, address, phone) may be used only to fulfil the order — not for unsolicited marketing — consistent with the DPDP Act, 2023 / GDPR as applicable.

7. Suspension & termination

GoTender may suspend or remove listings or accounts for breach of law or of this agreement, including counterfeit goods, unsafe food, repeated complaints or fraudulent conduct. You may close your account at any time; statutory record-keeping obligations survive termination.
