GoTender is built to operate lawfully as a marketplace in India and to respect equivalent rules worldwide. This page summarises the framework and what each party is responsible for.
India — key laws we follow
- Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020: marketplace model, no unfair trade practices, display of seller details, grievance redressal (acknowledgement within 48 hours, resolution within 1 month).
- Information Technology Act, 2000 & Intermediary Guidelines 2021: due-diligence obligations of an intermediary, notice-and-takedown for unlawful content.
- Digital Personal Data Protection Act, 2023: consent-based processing, data-principal rights.
- GST law (CGST Act, 2017): sellers declare GSTIN and correct tax rates/HSN codes; sellers are the suppliers of record.
- FSSAI (Food Safety and Standards Act, 2006): every food business on the Platform must hold and display an FSSAI license — it is mandatory at seller registration for food category sellers.
- Legal Metrology (Packaged Commodities) Rules, 2011: MRP and declarations on packaged goods.
Worldwide sellers
- Sellers outside India must declare a tax/VAT ID and registered legal name and comply with their local consumer-protection, food-safety, hospitality and distance-selling laws (e.g. EU Consumer Rights Directive, US FTC rules).
- Local mandatory consumer rights always prevail over anything in our terms.
What GoTender does
- Displays seller identity, location and statutory registrations on shop pages.
- Requires sellers to accept the Seller Agreement and declare required licenses before selling (FSSAI enforced for Indian food sellers).
- Provides order records, cancellation rights before dispatch, and verified-purchase-only reviews.
- Runs a grievance-redressal channel with statutory timelines.
- Removes unlawful listings on valid notice.
What sellers are responsible for
- Product/service quality, safety, accurate description, pricing, invoicing and taxes.
- Holding and renewing all licenses applicable to their trade.
- Honouring refunds, returns, warranties and consumer rights.
What customers should know
- Your contract is with the seller; GoTender helps you discover them and records the transaction.
- You can cancel before dispatch, review after delivery, and escalate complaints to our Grievance Officer and to your Consumer Commission / local authority.
